1. Introduction

These Terms and Conditions (“Terms”) govern your use of Acuity Education’s services, including tutoring, mentoring, learning resources, and any other related offerings (collectively, the “Services”).

By enrolling a student, booking a session, purchasing materials, or otherwise using our Services, you agree to be bound by these Terms, our Privacy Policy, our Cancellation Policy, and any other policies referred to in these Terms.

If you do not agree to these Terms, you should not use our Services.

2. Service Scope

Acuity Education provides online, primarily one-on-one tutoring and mentoring services for high school students. Additional group sessions, workshops, or learning resources may be offered from time to time.

We aim to provide high-quality educational support but do not guarantee specific academic outcomes.

3. Enrolment and Account Information

  • Parents/guardians must provide accurate and up-to-date information when enrolling a student.
  • You must inform us promptly of any changes to contact details, relevant health information, or technology requirements.
  • We reserve the right to refuse or discontinue Services where necessary, including for non-payment or breaches of these Terms.

4. Payment and Billing

  • Automated Weekly Billing: Parents/guardians must save a valid credit or debit card to their account for secure automated payments.
  • Invoicing: Invoices are issued weekly in arrears for all lessons completed in the prior week.
  • Receipts: Receipts are automatically generated and sent via our system.
  • Late Payment: If your payment fails, we may pause future sessions until the account is settled.

5. Cancellation and Rescheduling

  • Summary: Cancellations made more than 6 hours before a scheduled session may be rescheduled without charge. Cancellations made within 6 hours of the scheduled session time will incur a 50% lesson fee, unless there are extenuating circumstances. Missed sessions without notice will be charged in full.

6. Student Responsibilities

Students must:

  • Arrive on time for sessions.
  • Come prepared with necessary materials and ready to engage.
  • Maintain respectful behaviour towards tutors at all times.
  • Ensure a reliable internet connection and suitable learning environment for online sessions.

We reserve the right to discontinue Services if behaviour is persistently disruptive or inappropriate.

7. Session Recording

  • All online tutoring and mentoring sessions are recorded in full using secure video conferencing software.
  • Purpose: Recordings are used for quality assurance, training, dispute resolution, and to help ensure student safety.
  • Access: Recordings are stored securely and may only be accessed by authorised Acuity Education staff or tutors.
  • Retention: Recordings are kept for 90 days unless required longer for an investigation or legal obligation, after which they are permanently deleted.
  • Consent: By using our Services, you give consent (on behalf of yourself and/or your child) to be recorded during all online sessions. If you do not consent, you must notify us in writing before your first session. However, non-consent may mean we cannot provide Services.

8. Child Safety

Acuity Education is committed to creating and maintaining a safe, respectful, and inclusive environment for all children under the age of 18.

Our child safety commitments include:

  • Zero tolerance for child abuse in any form.
  • Working With Children Checks (Blue Cards) are mandatory for all tutors.
  • Mandatory reporting: If we suspect a child is at risk of harm, we will report it to the relevant authorities.
  • Parental presence: For younger students, we may request a parent/guardian be present or nearby during sessions.
  • Professional boundaries: Tutors must not have private contact with students outside of scheduled sessions or correspondence related to our Services, including via social media, messaging apps, or in-person meetings.
  • Session recording: All online sessions are recorded for safety purposes (see Section 7).
  • Respect and inclusion: We promote cultural safety, diversity, and participation for all students, including Aboriginal and Torres Strait Islander children, children from culturally and linguistically diverse backgrounds, and children with disabilities.

9. Learning Materials and Intellectual Property

  • Any materials provided by Acuity Education are for personal, non-commercial use only.
  • You may not reproduce, distribute, or modify our materials without written permission.
  • All intellectual property rights remain with Acuity Education.

10. Marketing and Testimonials

With your consent, we may use student success stories, testimonials, or images for promotional purposes.

  • Testimonials may be attributed by name unless you request anonymity.
  • Consent may be withdrawn at any time by contacting us in writing.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy. This includes details on how we collect, store, and use your data, and your rights to access or correct it.

12. Liability

  • To the extent permitted by law, our liability is limited to resupplying the Services or refunding the cost of Services provided.
  • We are not liable for indirect, incidental, or consequential loss, including loss of academic performance or opportunities.
  • Nothing in these Terms excludes your rights under the Australian Consumer Law.

13. Termination

Either party may terminate Services at any time by providing written notice.
We may terminate immediately if:

  • You breach these Terms;
  • Payment is overdue;
  • Safety or legal concerns arise.

14. Dispute Resolution

We aim to resolve concerns promptly and fairly.

  • Please contact us in writing outlining your concern.
  • If the matter cannot be resolved informally, it may be referred to mediation in Queensland before formal proceedings are commenced.

15. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on our website. Continued use of our Services after changes are published constitutes acceptance of the updated Terms.
